David Gouiran, MBA, JD edglawyer@aol.com -----Original Message----- From: David Gouiran edglawyer@aol.com To: eegouiran@aol.com eegouiran@aol.com Sent: Wed, Aug 27, 2014 4:00 pm Subject: Fwd: Basis for French Government Suit is not as understood by David acting as your "adviser" "Protection?" From what? The consequences of your own bad deeds? If there's any further legal expenses to be incurred, it will be to get that divorce. Why don't you focus on Helle and your family and leave us alone? It's possible to block an email sender. That's next if you don't pipe down. Worry about yourself--or not. David Gouiran MBA, JD Begin forwarded message: From: Donna Gouiran djnary@verizon.net Date: August 27, 2014 at 3:51:44 PM EDT To: David edglawyer@aol.com Subject: Fwd: Basis for French Government Suit is not as understood by David acting as your "adviser" Sent from my iPhone Begin forwarded message: From: "Emile E. Gouiran" eegouiran@aol.com Date: August 27, 2014 at 7:55:45 AM EDT To: "GOUIRAN Donna J. (Holmdel) (djnary@comcast.net)" djnary@verizon.net Subject: Basis for French Government Suit is not as understood by David acting as your "adviser" Reply-To: eegouiran@aol.com In rereading David's missive stating that he requires no help and threatening to report me to the French authorities, he seems to confuse post 1995 revenues and those you received (the income is always that of the owner) since 1989 through 1994 - those real estate revenues are what they have taxed and now propose to recover from you - before David they did not know where you were, and now they assume you are with me in Norway - even though that contradicts their records. Read in that way, David's missive if he is doing this for you, is totally off the mark. Moreover you can reassure him that the French government knows exactly where I live and that I am fully up-to-date on all tax reporting... moreover as my fiscal attorneys in Rouen will attest, regular fiscal audits are performed every three years - it's a horrible burden but at this conjuncture a regular practice. Note this attempt at recovery has nothing whatsoever to do with your income after 1995, and they do not seem to have gone through 1995. It is too late now for them to claim for periods after 1995. My concern is David's continued nonsense. If he awakens things in France (remember that spouses are severally and mutually liable for each other's tax liabilities) they will put a border check in place. That means that flights whose passenger manifests are forwarded prior to the plane's landing will reveal your presence on the plane. You'll be tagged at the border. Please Donna, trust me here, I have great experience in these matters. In fact I would advise you to postpone any travel plans you may have to Europe (there is now one central EU data base) until things cool down and we see where they intend to go after the rejected service. Incidentally David needs to learn that threats get him nowhere. What is important now, is that you provide me the name of a lawyer (even a US one) that I can discuss the matter with. At this point you need all the help you can get, and David can only get you into more trouble. The next thing I need to know, is whether you want to argue that the separation agreement is valid (it isn't under US law due to incurable error (malpractice against your lawyer would have been appropriate, but the action is time barred.) The French may not know that however - it could prove useful - also the status of our marriage as declared. I'm checking on all these things, however if you honestly believe that my help is absolutely not necessary as suggested by David please let me know because I am incurring expense and time to help you here and I would not want it to be for naught. Please separate your interest from anything David might suggest. Get yourself an independent lawyer and have him contact me, or trust that I have genuine interest in continuing to protect you, as I have for nearly three decades.
